Former Police Constable Paul Shearsby, based in the West Cumbria Territorial Policing Area, faced allegations that his conduct amounted to breaches of the Standards of Professional Behaviour in respect of:
• Honesty and Integrity
• Duties and Responsibilities
• Discreditable Conduct
On 3rd March 2021 PC Shearsby prepared a written witness statement for a member of the public in which he altered facts in order to give the impression that the member of the public had been the operator of a video camera when she had not. The video camera had captured evidence relevant to the case.
It was alleged that this conduct, if proven, amounted to Gross Misconduct and was so serious as to justify dismissal.
Finding of the hearing
The panel found that former PC Shearsby’s conduct amounted to breaches of the standards of professional behaviour, in respect of Honesty and Integrity, Duties and Responsibilities and Discreditable Conduct, resulting in a finding of Gross Misconduct.
Former PC Shearsby submitted his resignation in January 2022 and left the force in February 2022. However, the officer’s actions were judged so serious that, had he still been a serving police officer, he would have been dismissed.
