Summary

A misconduct hearing for police constable Henry Green was held in public on 11 – 13 July 2022 and 25 July 2022. The hearing was conducted before Legally Qualified Chair Miss O.M. Iguyovwe, OBE, Lay Panel Member Mr Stan Irwin, and Police Panel Member Superintendent 5533 Jenny Bristow.

The allegations are set out below: –

1. On 6 June 2019, while attending an incident at Tesco Express, Newland Avenue, PC Green applied force to a female detainee, which was not necessary, proportionate, or reasonable in the circumstances. In particular he:

a) used a leg sweep causing her to fall to the floor;
b) did this while she was handcuffed and unable to break her fall;
c) failed to adequately physically support and control her while she was taken to the floor to minimise risk of serious injury.

2. On 6 June 2019, PC Green applied force to male detainee, which was not necessary, proportionate, or reasonable in the circumstances. In particular he:

a) hit the man in the face whilst holding a pair of handcuffs;
b) did this while he was handcuffed.

The above conduct breached the Standards of Professional Behaviour relating to Use of Force and individually and/or cumulatively amounts to Gross Misconduct.

Having heard all the available evidence and submissions on behalf of the Appropriate Authority and Former PC Green himself, the Panel found that PC Green’s conduct amounted to Gross Misconduct in this case. The reasons for this finding are the nature and seriousness of the breach. The conduct includes leg swiping a female detainee and causing her to land on the hard floor without adequately supporting her while she was handcuffed and striking another detainee to the head while holding a pair of metal handcuffs while the detainee was himself in handcuffs.

Maintaining public confidence and deterring future breaches of the Standards of Professional Behaviour, require this type of behaviour to be marked as Gross Misconduct.

At the conclusion of proceedings on 25 July, PC Green was dismissed from the force without notice and he was also placed on the Barred List for a minimum of 5 years, restricting him from being employed by another police force or specified law enforcement bodies.
