Two allegations of gross misconduct against a former police officer have been proven following an accelerated hearing last month.
The hearing in relation to former Police Constable Adam Davies was held at Surrey Police Headquarters on 10 December 2021.
Mr Davies did not attend the proceedings but was represented at the hearing and had also responded to the allegations in writing.
The first allegation was that between 20 October 2020 and 16 December 2020 and while he was a serving officer, he received seven racist and otherwise deeply offensive images on his mobile phone which he failed to delete or challenge. Evidence also showed that one of the images was forwarded on.
The second allegation related to an incident on 22 August 2019 during which Mr Davies took an indecent image of himself while on duty and in full uniform.
Both allegations were proven after being found to breach the Standards of Professional Behaviour for Authority, Respect and Courtesy, Equality and Diversity and Conduct (Discreditable).
In determining the outcome, Chief Constable Gavin Stephens said: “This is behaviour that not only breaches the Standards of Professional Behaviour, but is also in contradiction of our Code of Ethics, the attestation taken by police officers, and undermines what we stand for in Surrey. There is no place in Surrey Police, or policing nationally, for anyone with discriminatory attitudes to race and disability.”
CC Stephens added: “Taking into account former PC Davies’ culpability, the discriminatory aspects of the behaviour, and the behaviour on duty and in uniform, and the effects that this pattern of behaviour would have on public confidence, I determine that his cumulative conduct amounts to serious gross misconduct. If he had still been serving, he would have been dismissed without notice.”
