PC Charlie Merritt     –     Metropolitan Police Service,

On 13 February 2022, whilst off duty, former PC Merrit was present at a house party attended by his friends and whilst there became involved in an altercation with another male. This concluded with former PC Merritt assaulting that male.

On 4 April 2022 following an investigation by Essex Police, former PC Merritt was charged with the offence of assault by beating contrary to Section 39 of the Criminal Justice Act 1988.

On 5 May 2022, at Basildon Magistrates Court, former PC Merritt pleaded guilty to the offence and was convicted and ordered to pay a fine of £640.00, compensation of £100.00, victim services of £64.00 and costs of £105.00 (a total of £909.00).

Between September 2019 and December 2020 he failed to be diligent in the exercise of his duties in that he failed, without reasonable excuse, to take a statement from a named witness;
In or about December 2020 he failed to be open and honest with his supervisor in that he made the following false statement to him:
In or around December 2020, that he had tried to contact with the witness on the and December 2 and 3, 2020 but had not received a response from him;

1. On 6 June 2019, while attending an incident at Tesco Express, Newland Avenue, Hull, you applied force to [complainant A], which was not necessary, proportionate or reasonable in the circumstances. In particular you:

a) Used a leg sweep causing [complainant A] to fall to the floor;
b) Did this while [complainant A] was handcuffed and unable to break her fall;
c) Failed to adequately physically support and control [complainant A] while she was taken to the floor to minimise risk of serious injury.

2. On 6 June 2019, you applied force to [complainant B], which was not necessary, proportionate or reasonable in the circumstances. In particular you:

a) Hit [complainant B] in the face whilst holding a pair of handcuffs;
b) Did this while [complainant B] was handcuffed.

The above conduct breached the Standards of Professional Behaviour relating to Use of Force and individually and/or cumulatively amounts to Gross Misconduct.

The hearing is to be held in public.

It is alleged that the officer concerned has over a period of time used inappropriate sexualised language and sexual innuendo to female colleagues, many of whom have been junior to the officer concerned or for whom they had supervisory responsibility. Some of the comments made by the officer concerned were made on duty and within the workplace. On other occasions, the comments have been made off duty using social media and text messages. In some instances, the officer concerned has sent messages to female colleagues late at night.

The conduct as alleged above is a breach of the Authority, Respect and Courtesy standard, a standard which requires officers to act with self-control, treating members of the public and colleagues with respect and courtesy.

On 25 February 2021 PC James Clayman conducted a PNC (Police National Computer) check on a vehicle and further four PNC driver enquiries. He was shown as self-certified sick on the day in question. There was no justifiable policing purpose for any of the intelligence checks he carried out on MPS systems.

On Monday 1 March 2021 PC Clayman conducted one PNC check on a vehicle. He was on annual leave when the check was conducted and there was no justifiable policing purpose for carrying out the check.

On 2 April 2021, PC Clayman conducted three PNC person checks and a vehicle check. He also conducted one IIP (Integrated Information Platform) check on a vehicle and two further PNC driver enquiry checks. PC Clayman was on a rest day when the checks were conducted and there was no justifiable policing purpose for any of the checks.

On 11 January 2022 at Westminster Magistrates Court, PC Martin plead guilty to an offence of Common Assault (Battery). He was sentenced to a curfew order for 14 weeks and ordered to pay costs and a victim surcharge.
