Former Officer X     –     Kent Police,

It is alleged that former Officer X assaulted his former partner’s new partner, Mr A.

This followed a verbal altercation between former Officer X and Mr A the previous month.

Former Officer X was arrested for assault, and due to inculpatory evidence suspected to be on his phone in the form of text messages, his personal and work mobile phones were seized and forensically analysed.

Upon analysis, a number of sexually explicit images of himself, taken within the workplace, were revealed on his phone.

In the summer of 2019, the Officer engaged in unsolicited contact via Instagram with a female, Miss B aged 23, he had met in the course of his duties. Miss B worked at Luton Airport. The Officer paid Miss B a lot of compliments. He knew her full name. This made her feel uncomfortable as she had not told it to him.

The Officer found Miss B on Instagram and began to send her messages. Miss B felt this was inappropriate as they were not friends and there was a significant age difference between them. The Officer’s role made Miss B feel uncomfortable as she did not know what to do and she did not want to create any issues.
Eventually, Miss B reported the matter to her manager Miss C. Miss C had also received messages from the Officer complimenting her on her appearance and she too felt uncomfortable with the Officer and both Miss B and Miss C then took steps to avoid him. Miss B made a complaint to another officer that resulted in the Officer having a one to one with a Police Sergeant on 18 September 2019. In the course of that one to one the Officer was told that:
(i) The complaint had been made.
(ii) The complainant had been advised to ‘block’ you.
(iii) The police need to always maintain a professional relationship with their partner agencies and to ensure that they feel confident that the police are there to keep them safe and secure.

Thereafter Miss B would hide in the office to avoid the Officer.

On 26 October 2019, the Officer sent Miss D’s name from his work mobile phone to his personal mobile phone.

On 7 November 2019, the Officer sent four Snapchat friend requests to individuals called ‘Miss D’. None of these were the Miss D that worked at Luton Airport.

Miss D considers that the Officer would go out of his way to approach her and to stand next to her. He made her feel uncomfortable.

On 14 February 2020, Valentine’s Day, the Officer approached Miss D, who was 19 years old, and asked her if she had any valentine’s day cards. She told the Officer that she had not. The Officer then said that a beautiful girl like Miss D should have received some. This made Miss D feel uncomfortable and creeped out.

In February 2020, Miss D received a series of highly sexualised messages via SnapChat. The person sending the messages said that they were in their forties and too old for Miss D. They also appeared to know when she was going to and from work. Miss D had previously told the Officer when her birthday was and what she was going to do to celebrate it. On her birthday she received SnapChat messages telling her to have a nice evening and that the sender liked it when she wore heels. As a result of the Officer’s behaviour towards her she believed that it may be the Officer sending her these messages.

PC Inga Gherghel     –     Metropolitan Police Service,

It is alleged that during early 2020, PC Gherghel’s husband, along with another were responsible for the theft of large amounts of cash from members of an Organised Criminal Network (OCN). PC Gherghel’s husband, although not a police officer, was in pseudo-police uniform and wearing a MetVest.

On 28 April 2020 her husband was arrested. PC Gherghel was present when this occurred. A search was conducted at the home address where a MPS MetVest was found. In the cupboard where it was found, there were other coats, jackets, mobile phones also found inside, belonging to all occupants of the house, indicating that it was regularly used. The MetVest was clearly visible to anyone opening the cupboard. It had not been issued to PC Gherghel.

In addition to the MetVest, a shoebox was discovered in the wardrobe in the bedroom containing over £10,000 in cash.

It is alleged that the presence of the MetVest and the contents of the shoebox were known to PC Gherghel and that she knowingly concealed the presence of them, knowing or believing the money to be the proceeds of crime and the MetVest to be an article used in the course of a crime.

Alternatively, being aware of the presence of the said items, she wilfully failed to enquire further in to the origin or purpose of the items and as to what either might be doing in her flat.

The matters set out above are individually and/or collectively so serious that they amount to gross misconduct.

DC 5545 Wharmby     –     West Midlands Police,

On 27th March 2022, whilst off duty driving his personal vehicle former Detective Constable Wharmby drove whilst over the prescribed limit for alcohol.

On 13.04.2022, he pleaded guilty at court to driving with excess alcohol and was dealt with by way of a 15-month disqualification from driving and a fine.

iii) The level of force he used was more than the minimum amount necessary to achieve the required result.
Duties and Responsibilities in that he:
a. failed to set out full, accurate, or complete details about the force he used against a suspect.
b. failed to complete a Use of Force form.
Discreditable Conduct in that his actions as set out above, or each of them, brought discredit on the police force and/or undermined public confidence in it.

On 13 February 2022, whilst off duty, former PC Merrit was present at a house party attended by his friends and whilst there became involved in an altercation with another male. This concluded with former PC Merritt assaulting that male.

On 4 April 2022 following an investigation by Essex Police, former PC Merritt was charged with the offence of assault by beating contrary to Section 39 of the Criminal Justice Act 1988.

On 5 May 2022, at Basildon Magistrates Court, former PC Merritt pleaded guilty to the offence and was convicted and ordered to pay a fine of £640.00, compensation of £100.00, victim services of £64.00 and costs of £105.00 (a total of £909.00).

t is alleged that the officer concerned has over a period of time used inappropriate sexualised language and sexual innuendo to female colleagues, many of whom have been junior to the officer concerned or for whom they had supervisory responsibility. Some of the comments made by the officer concerned were made on duty and within the workplace. On other occasions, the comments have been made off duty using social media and text messages. In some instances, the officer concerned has sent messages to female colleagues late at night.

The conduct as alleged above is a breach of the Authority, Respect and Courtesy standard, a standard which requires officers to act with self-control, treating members of the public and colleagues with respect and courtesy.

On 25 February 2021 PC James Clayman conducted a PNC (Police National Computer) check on a vehicle and further four PNC driver enquiries. He was shown as self-certified sick on the day in question. There was no justifiable policing purpose for any of the intelligence checks he carried out on MPS systems.

On Monday 1 March 2021 PC Clayman conducted one PNC check on a vehicle. He was on annual leave when the check was conducted and there was no justifiable policing purpose for carrying out the check.

On 2 April 2021, PC Clayman conducted three PNC person checks and a vehicle check. He also conducted one IIP (Integrated Information Platform) check on a vehicle and two further PNC driver enquiry checks. PC Clayman was on a rest day when the checks were conducted and there was no justifiable policing purpose for any of the checks.
