PC 0044 Loi     –     West Midlands,

West Midlands Police Headquarters

Alleged Breaches

  • Duties and responsibilities

The hearing is to be held in public.

On 1 May 2020 PC Loi was driving an unmarked police car when he observed a road traffic collision, which he reported to the force control room. The officer was informed that one of the drivers had run away from the scene and had been detained a short distance away by members of the public.

On arrival at the location he saw members of the public detained the driver face down on the ground. He was informed that the driver had been resisting restraint shortly beforehand. The officer decided to apply handcuffs.

The driver did not provide any active resistance to the officer and was not speaking or moving. A member of the public involved in the restraint expressed the view that the driver was ‘putting it on’.

PC Loi shook the driver to rouse him but obtained no response. He did not make any further inquiries to establish whether the driver’s unresponsiveness was genuine or not. The officer requested an ambulance but did not commence first aid.

On other officers arriving in just over a minute, PC Loi briefed them and they commenced first aid. Ambulance and medical staff subsequently arrived and took over the primary care.

It is alleged that PC Loi failed to conduct his own assessment of the situation and did not provide any adequate care or first aid, contrary to his training and his duty as constable to protect life.
