Circumstances of Alleged Breaches

On 19 July 2021, PC Philips was required to provide a urine sample for a with cause drug test. The sample was sent for analysis and was found to contain the following anabolic steroids:

a. Trenbolone.

b. Nandrolone.

c. Testosterone.

PC Philips had taken anabolic steroids.

PC Philips either knew or ought to have known that he had purchased and taken anabolic steroids.

Alternatively, to paragraph 3 above, PC Philips was reckless in purchasing and then taking the substances from Mr W.

  1. PC Philips breached the Standards of Professional Behaviour of ‘discreditable conduct’ because he was required not to behave in a manner, whether on or off duty, which brings discredit on the police service or undermines public confidence in policing. The above behaviour breached this standard because:a. PC Philips took anabolic steroids.b. PC Philips either knew or ought to have known that he had purchased and taken anabolic steroids.

    c. Alternatively, PC Philips was reckless in purchasing and then taking the substances from Mr W.

    d. PC Philip’s purchase of the anabolic steroids necessitated him involving himself with illegal activity namely the supply of a Class C substances under the Misuse of Drugs Act 1971.

    e. The taking of anabolic steroids had the potential to adversely affect his behaviour by for example increasing his propensity to violence or aggressive behaviour.

    f. The fact that PC Philips had taken anabolic steroids is potentially disclosable in an MG6B (see for example case 42/12390/20) and has the potential to undermine public confidence in the police.

  2. PC Philips breached the Standards of Professional Behaviour of ‘fitness for work’ because he was required to ensure that he was fit to carry out his role in policing and fulfil his responsibilities and not to misuse legal drugs or other legal substances. The above behaviour breached this standard because:a. The taking of anabolic steroids had the potential to adversely affect his behaviour by for example increasing propensity to violence or aggressive behaviour.
