The officer makes an application for anonymity. Oral submissions have been made on behalf of the officer and the chair is invited to consider those submissions in addition to the confidential documentation placed for the chair’s consideration. The Appropriate Authority made oral submissions; their position is that they are essentially neutral.
The relevant provisions are set out in the Home Office Guidance 2020 and the relevant Regulations.
Submissions made on behalf of the officer are based on the welfare of a third party, that third party is a child who is associated with the officer. Confidential documentation has been provided which shows a history of significant concern for the welfare of the child, the officer submits this remains current and ongoing. The core of the submissions made on behalf of the officer are that publicly identifying the officer may directly and significantly impact on the welfare of that child. The officer submits the confidential material provided supports that assertion.
Submissions are made that paragraph 11.84 HOG is relevant. This paragraph states that the chair may consider imposing some restrictions based on their assessment, a variety of factors may be considered, some are listed at 11.84, but the chair is not limited to those factors. Paragraph 11.84 (g) refers to “the welfare of any third party.”
The parties acknowledge the need for transparency of the police discipline and/or complaints system, the public interest in proceedings and the public interest in transparency.
