Circumstances of Alleged Breaches

On 13 October 2020, whilst off duty, Ms Miah gave witness evidence in a personal capacity at an appeal hearing at Luton Crown Court. The hearing related to Ms Miah’s former occupation as a lettings assistant/manager at a lettings agency. Ms Miah was financially connected to the appellant because she jointly owned property with him.

Ms Miah gave evidence that; she dealt with most administrative things at the company; she had no knowledge of certain properties being rented out as Homes in Multiple Occupation; evidential Gumtree adverts related to other addresses and not those central to the case; and that no connection remained between herself and the letting agency.

The appeal Justices found that Ms Miah was “…a poor witness, an unconvincing witness determined to mislead us.”. Some of Ms Miah’s evidence was described as “…unconvincing…artificial and obviously false…since she is a police officer we are particularly concerned about the misleading evidence that she gave to us”.

The Crown Prosecution Service have determined that the Judge’s findings against Ms Miah amount to an Adverse Judicial Finding, this is likely to negatively affect her credibility as a witness in any future judicial cases.
