An Officer Who Had Sex With Another Officer Whilst On Duty Given a Final Written Warning Whilst Another Was Dismissed

Between 25th January 2021 and 05 February 2021 a misconduct hearing was
held in respect of two Derbyshire police officers.
Having received representations from varying parties, the Legally Qualified
Chair – Mr Geoff Payne determined that the hearing be held in private.
Officer (A) answered allegations that their conduct had breached the
Standards of Professional Behaviour of ‘Authority, Respect and Courtesy’,
‘Discreditable Conduct’ and ‘Duties and Responsibilities’, contrary to the Police
(Conduct) Regulations 2012, in that:
• The officer engaged in sexual activity whilst on duty and had sent
indecent and inappropriate images/messages.
Officer (A) denied that their conduct amounted to Gross Misconduct. The
Panel found a number of the allegations to be proven and that the officer’s
conduct did amount to Gross Misconduct.
It was the decision of the Panel that Officer (A) be dismissed without notice.
Officer (B) answered allegations that their conduct had breached the
Standards of Professional Behaviour of ‘Authority, Respect and Courtesy’,
‘Discreditable Conduct’ and ‘Duties and Responsibilities’, contrary to the Police
(Conduct) Regulations 2012, in that:
• The officer engaged in sexual activity whilst on and off duty (with an on duty officer)
Officer (B) accepted the allegations as alleged. The Panel found the officer’s
conduct amounted to a combination of Misconduct and Gross Misconduct.
It was the decision of the panel that Officer (B) be given a Final Written
Warning (18 Months).
